Terms of Use

1. Definitions.
The www.inspireddiversions.com Web site (the “Site”) is the interactive online service operated by Inspired Diversions ("Inspired Diversions") on the World Wide Web of the Internet and consists of information, services, and content. "Visitor" means each person who accesses the Inspired Diversions Site. By accessing the Site, the Visitor is deemed to have agreed to comply with all of the terms and conditions hereof.

2. General.
Inspired Diversions shall have the right at any time to change or discontinue any aspect or feature of the Site, including, but not limited to, content, hours of availability, and equipment needed for access or use.

3. Changed Terms.
Inspired Diversions shall have the right at any time to change or modify the terms and conditions applicable to the Visitor's use of the Site or any part thereof, or to impose new conditions. Such changes, modifications, additions, or deletions shall be effective immediately upon posting on the Web site or by any means of notification by which the Visitor obtains actual knowledge thereof. Any use of the Site by Visitor after such notice shall be deemed to constitute acceptance by the Visitor of such changes, modifications, additions or deletions.

The Site contains copyrighted material, trademarks and other proprietary information including, but not limited to, text, software, photos, video, graphics, music and sound, and the entire contents of the Site are copyrighted as a collective work under the United States copyright laws. Inspired Diversions owns and/or controls copyright in the selection, coordination, arrangement and enhancement of such content, as well as in the content original to it. The Visitor may not modify, publish, transmit, participate in the transfer or sale, create derivative works, or in any way exploit, any of the content, in whole or in part. Except as otherwise expressly permitted under copyright law, no copying, redistribution, publication or commercial exploitation of downloaded material will be permitted without the express permission of Inspired Diversions and the copyright owner.

5. Links to Third Party Sites.
This Site includes links to other World Wide Web sites or resources ("External Web Sites"). Because Inspired Diversions has no control over External Web Sites and resources, you acknowledge and agree that Inspired Diversions is not responsible for the availability of such External Web Sites or resources, and does not endorse and is not responsible or liable for any content, advertising, products, or other materials on or available from such External Web Sites or resources. You further acknowledge and agree that Inspired Diversions shall not be responsible or liable, directly or indirectly, for any damage or loss caused by or in connection with use of or reliance on any such content, goods or services available on or through any such External Web Site or resource. Finally, you acknowledge that such External Web Sites usually have their own terms and conditions, including privacy policies, over which Inspired Diversions has no control and which will govern your rights and obligations with respect to the use of those External Web Sites.

6. Event Ticket Refunds & Exchanges
Event ticket purchases are handled by third-party Web Sites and affiliate partners. If you book an Attraction, Show, Entertainment, Sporting Event, Restaurant or Tour, which is date specific, the tickets cannot be refunded or exchanged unless the performance is cancelled.

7. Disclaimer of Warranty; Limitation of Liability.
(A) VISITOR EXPRESSLY AGREES THAT USE OF THE SITE IS AT VISITOR'S SOLE RISK. INSPIRED DIVERSION'S DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED OR ERROR FREE; NOR DOES IT MAKE ANY WARRANTY AS TO THE RESULTS THAT MAY BE OBTAINED FROM USE OF THE SITE, OR AS TO THE ACCURACY, RELIABILITY OR CONTENT OF ANY INFORMATION, SERVICE, OR MERCHANDISE PROVIDED THROUGH THE SITE.

(C) THIS DISCLAIMER OF LIABILITY APPLIES TO ANY DAMAGES OR INJURY CAUSED BY ANY FAILURE OF PERFORMANCE, ERROR, OMISSION, INTERRUPTION, DELETION, DEFECT, DELAY IN OPERATION OR TRANSMISSION, COMPUTER VIRUS, COMMUNICATION LINE FAILURE, THEFT OR DESTRUCTION OR UNAUTHORIZED ACCESS TO, ALTERATION OF, OR USE OF RECORD, WHETHER FOR BREACH OF CONTRACT, TORTIOUS BEHAVIOR, NEGLIGENCE, OR UNDER ANY OTHER CAUSE OF ACTION. VISITOR SPECIFICALLY ACKNOWLEDGES THAT INSPIRED DIVERSIONS IS NOT LIABLE FOR THE DEFAMATORY, OFFENSIVE, OR ILLEGAL CONDUCT OF OTHER VISITORS OR THIRD PARTIES AND THAT THE RISK OF INJURY FROM THE FOREGOING RESTS ENTIRELY WITH THE VISITOR.

8. Indemnification.
Visitor agrees to indemnify and hold harmless Inspired Diversions from and against all claims and expenses, including attorneys' fees, arising out of the use of the Site by Visitor.
